1. Who we are

Soul Kicks is a sole proprietorship based in Holbrook, Arizona, United States, operating the online store at soul-kicks-7395.myshopify.com. "We", "us", and "our" refer to Soul Kicks. "You" refers to you, the visitor or customer.

2. Agreement

By visiting our store or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the site. We may update these terms at any time, and the version posted here is the one that applies.

3. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.

4. Products

Our apparel is printed to order. We do our best to display colors accurately, but screens vary and printed colors may differ slightly from what you see. Garment measurements can vary by up to an inch. These variations are normal and are not defects.

5. Pricing and payment

All prices are in US dollars and may change without notice. We reserve the right to correct pricing errors, and to cancel and refund an order placed at an incorrectly listed price. Payment is taken at checkout through Shopify's payment processing; we never see or store your full card details.

6. Orders

Receiving an order confirmation does not guarantee acceptance. We may refuse or cancel any order, including for suspected fraud, unavailable stock, or pricing errors. If we cancel, you receive a full refund.

7. Changes and cancellations

Because printing starts quickly, we can usually only change or cancel an order within 12 hours of purchase. Email us as soon as possible and we'll do what we can.

8. Shipping and returns

Shipping timelines and costs are set out in our Shipping Policy. Returns and refunds are governed by our Returns & Refunds policy. Both are part of these terms.

9. Intellectual property

All designs, artwork, slogans, logos, photographs, and text on this site are the property of Soul Kicks and are protected by copyright and trademark law. You may not reproduce, resell, or use our designs on your own products without written permission.

10. Your content

If you send us photos, reviews, or other content, you grant us a non-exclusive, royalty-free right to use it in our marketing. You confirm the content is yours to share.

11. Acceptable use

Do not use this site to break the law, infringe anyone's rights, transmit malicious code, or interfere with the site's operation.

12. Third-party services

We rely on third parties including Shopify for hosting and payments and print-on-demand partners for fulfillment. Their handling of your information is governed by their own terms and privacy policies.

13. Disclaimer of warranties

The site and our products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to your order or use of this site is limited to the amount you paid for the products in question. We are not liable for indirect, incidental, or consequential damages.

15. Indemnification

You agree to indemnify and hold Soul Kicks harmless from any claim or demand arising out of your breach of these terms.

16. Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Navajo County, Arizona.

17. Severability

If any part of these terms is found unenforceable, the rest remains in effect.
